REFUND_POLICY

1. SERVICE_COMMENCEMENT
Upon payment confirmation, KinetixVertex initiates project kickoff procedures. A 14-day cooling-off period applies from the date of initial payment, during which a full refund may be requested provided substantial work has not commenced.
2. MILESTONE_BASED_REFUNDS
For projects structured with milestones, refunds are calculated based on completed versus pending deliverables. Completed milestones are non-refundable. Pending milestones may be cancelled with proportional refund.
3. CUSTOM_DEVELOPMENT
Custom development work is subject to milestone-based refund terms. Once a development phase is completed and approved, that phase becomes non-refundable. Technical documentation and source code delivery constitute phase completion.
4. REFUND_PROCESSING
Approved refunds are processed within 14 business days via the original payment method. KinetixVertex reserves the right to deduct administrative fees for payment processing costs.
5. EXCEPTIONS
No refunds are provided for: (a) Completed and approved work phases, (b) Third-party service fees, (c) Domain registrations and hosting prepayments, (d) Custom plugin development after delivery, or (e) Security audit reports after delivery.
6. DISPUTE_RESOLUTION
Refund disputes should be directed to [email protected]. KinetixVertex commits to resolving disputes within 30 days through direct communication. Unresolved disputes may be escalated to relevant consumer protection authorities.
TERMS_OF_SERVICE

1. SERVICE_ACCEPTANCE
By engaging KinetixVertex services, you agree to these Terms of Service. KinetixVertex, registered at Calle Tirso de Molina 1, Planta Baja, Parla, Madrid, Spain, provides digital infrastructure engineering services under these terms.
2. SCOPE_OF_SERVICES
Services include multi-vendor marketplace development, trading platform engineering, API integration, cloud infrastructure setup, and related technical consulting. Specific deliverables, timelines, and costs are defined in individual project agreements.
3. INTELLECTUAL_PROPERTY
Upon full payment, clients receive ownership of custom-developed code and designs. KinetixVertex retains rights to proprietary frameworks, methodologies, and general-purpose components. Open-source components remain under their respective licenses.
4. CONFIDENTIALITY
Both parties agree to maintain confidentiality regarding proprietary information, technical specifications, and business data shared during the engagement. This obligation survives termination for a period of 24 months.
5. LIMITATION_OF_LIABILITY
KinetixVertex liability is limited to the total value of the specific project engagement. We are not liable for indirect, consequential, or punitive damages. Force majeure events excuse performance obligations.
6. TERMINATION
Either party may terminate with 30 days written notice. KinetixVertex may terminate immediately for material breach or non-payment. Upon termination, client receives all completed work and documentation.
7. GOVERNING_LAW
These terms are governed by Spanish law. Disputes shall be resolved in the courts of Madrid, Spain, without prejudice to consumer protection rights under EU directive.
8. AMENDMENTS
KinetixVertex reserves the right to amend these terms with 30 days notice. Continued service acceptance constitutes agreement to amended terms. Material changes require explicit re-acceptance.
